Terms of Service

1. Acceptance of Terms

By downloading, installing, or using KodamaTalk ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Eligibility

You must be at least 13 years of age to use the App. If you are under 18, you represent that you have your parent's or legal guardian's permission to use the App.

3. Description of Service

KodamaTalk is an AI-powered language learning application. The Service includes:

  • AI-generated voice conversations in Japanese
  • Speech recognition and transcription
  • Learning progress tracking (XP, streaks, vocabulary)
  • Virtual spirit companion system with evolution mechanics
  • Push notifications (optional)

4. Subscription & Payments

4.1 Subscription Plans

  • Monthly Plan: $9.99 USD per month
  • Annual Plan: $79.99 USD per year ($6.67/month)

4.2 Automatic Renewal

Subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the end of the current period.

4.3 Cancellation

You can cancel your subscription at any time through your device's subscription management:

  • iOS: Settings > [Your Name] > Subscriptions > KodamaTalk > Cancel
  • Android: Google Play Store > Profile > Payments & subscriptions > KodamaTalk > Cancel

You will retain access until the end of your current billing period.

4.4 Refunds

Refund requests are handled by Apple or Google according to their respective policies.

5. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose
  • Reverse-engineer, decompile, or disassemble the App
  • Interfere with or disrupt the Service
  • Attempt to gain unauthorized access to the Service
  • Harass, abuse, or harm another person
  • Use automated scripts, bots, or other tools
  • Manipulate XP, streaks, or spirit evolution through exploits
  • Share account credentials or operate multiple accounts
  • Use the AI to generate illegal, hateful, or sexually explicit content
  • Record, redistribute, or commercially exploit generated conversations

6. Intellectual Property

All content, features, and functionality of the App — including spirit companion designs, character names (Kogitsune, Kohouou, Kokirin), artwork, animations, UI design, text, graphics, logos, and software — are owned by KodamaTalk and protected by intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license for personal, non-commercial language learning purposes.

7. AI Disclaimer

KodamaTalk uses AI to generate conversational responses. Please be aware that:

  • AI-generated content may contain errors in grammar, vocabulary, or cultural context.
  • The App is not a substitute for professional language instruction.
  • AI responses may vary due to the nature of language models.
  • Speech recognition has limitations based on pronunciation and environment.

We are not liable for consequences arising from reliance on AI-generated content.

8. Account Deletion

You may request deletion of your account at any time. Upon requesting account deletion:

  • Your account will be immediately soft-deleted (deactivated).
  • There is a 30-day grace period during which you can request restoration.
  • After 30 days, your account and all data will be permanently deleted.
  • This includes all learning progress, spirit companions, XP, streaks, and conversation history.
  • You must cancel your subscription separately through the App Store or Google Play.

9. Limitation of Liability

To the fullest extent permitted by law, KodamaTalk shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability shall not exceed the amount you paid in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless KodamaTalk from any claims arising out of your use of the Service or violation of these Terms.

11. Service Modifications

We reserve the right to modify, suspend, or discontinue the Service at any time. We will make reasonable efforts to provide advance notice of significant changes.

12. Changes to Terms

We may update these Terms from time to time. Your continued use of the Service after the effective date constitutes acceptance of the changes.

13. Governing Law

These Terms shall be governed by the laws of Japan, without regard to conflict of law provisions.
